Terms of Service

By purchasing from NJM Artworks, you agree to the following terms and conditions. Please read them carefully before completing your purchase.

1. Intellectual Property & Copyright

  • Ownership: The Artist N J Molloy retains all reproduction rights and copyright to the artwork, including the right to create prints or derivative works of the piece, even after the original is sold.

  • Usage: The purchase of an original work of art does not grant the buyer any licensing or reproduction rights. You may not scan, copy, print, or otherwise redistribute the image for commercial gain without express written soul-consent from the Artist.

  • Social Media: You are encouraged to share photos of the art in your home! Please credit the Artist where possible.

2. Accuracy of Information

  • Visual Representation: Every effort is made to display colors and textures accurately. However, because every screen displays color differently, the physical artwork may vary slightly from the digital preview.

  • Sizing: All dimensions are listed in the product description. Please measure your space carefully before purchasing.

3. Payment & Pricing

  • Payment Methods: All payments are processed securely through PayPal. Orders will not be shipped until payment is cleared.

  • Tax/Duties: For international orders, the buyer is responsible for any customs fees, duties, or value-added taxes (VAT) imposed by their country.

4. Shipping & Risk of Loss

  • Handing Time: Original works typically ship within 10 business days.

  • Shipping Risk: Once the artwork is handed over to the carrier (e.g., FedEx, UPS, DHL), the risk of loss or damage passes to the buyer. However, I provide tracking and insurance for all original works to ensure you are protected in the event of a mishap.

5. Commissioned Works

  • Deposits: A non-refundable deposit of 50% is required to begin any custom commission.

  • Approval: For commissions, the buyer will be sent a final photo for approval. Once approved and the final balance is paid, no further changes can be made and the sale is final.

6. Limitation of Liability

NJM Artworks and the Artist shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the website or the purchase of artwork. In all cases, the maximum liability is limited to the purchase price of the item in question.

7. Governing Law

These terms are governed by the laws of Scotland. Any disputes arising from these terms shall be resolved in the courts of Scotland.
